VICTORIA has broken ranks with NSW and Queensland and will not enforce a mandatory minimum penalty for major infractions such as jockeys betting or fixing races.

ROD NICHOLSON reports in the MELBOURNE HERALD SUN that Racing Victoria chairman Michael Duffy said Victoria preferred to allow the Racing Appeals and Disciplinary Board to consider extenuating circumstances when applying a penalty.

That may mean a lesser penalty than the minimum (two years for betting and five years for race fixing for jockeys) or a harsher penalty, depending on the individual situation.

THE Australian Racing Board has today announced minimum penalties for integrity offences having initiated a review at its Board meeting on 22 November, 2012.

“The new regime of uniform penalties will ensure consistency of penalties across all State and Territory jurisdictions and act as a strong deterrent to potential wrongdoers,” Chief Executive Peter McGauran said today.

“Penalties are an essential element in deterring cheats and maintaining public confidence. The penalties announced send the strongest and clearest signal yet to offenders that they will pay a heavy price for cheating the system. This is especially the case for repeat offenders who have no place in the industry. Whilst first time offenders will suffer a heavy enough penalty as it is, repeat offenders will face penalties in excess of the minimum in keeping with the intent of the rules.” Mr McGauran said.

SYDNEY trainer Con Karakatsanis and stablehand father Tony will lodge an appeal to VCAT to rehear charges of conspiring to stomach tube their horse Howmuchdoyouloveme on the day of a Flemington race last spring carnival.

ROD NICHOLSON reports for the MELBOURNE HERALD SUN that their solicitor John Carmody announced immediately after Racing And Disciplinary Board chairman Russell Lewis disqualified Con for nine months and Tony for two years that the pair "disagreed with the verdict and wanted to clear their names."

He said application would be made for a stay of proceedings to allow Con Karakatsanis to continue training.

 

RACING Victoria has taken the unusual step of apologizing to trainer Danny O'Brien for any incorrect perception that a breach of the rules had occurred after last Saturday's post race meeting swabbing of two of his horses.
